YUBIT Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the YUBIT website (https://www.yubit.com) and the services provided by YUBIT LIMITED (“YUBIT,” “we,” “us,” or “our”). These Terms, together with any documents expressly incorporated by reference (collectively, the “Agreement”), form the entire agreement between you and YUBIT regarding the Services. If any inconsistency arises between these Terms and incorporated documents, these Terms prevail.
By accessing or using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not access or use the Services.
YUBIT may update these Terms at any time by posting the revised version on the Website. Your continued use constitutes acceptance of the changes.
If the Agreement is provided in multiple languages, the Chinese version controls in case of conflict or omissions.
1) Nature of the Services & Key Risks
YUBIT operates an online platform for digital-asset trading and related services. YUBIT is not an issuer of digital assets, does not provide fiat deposit/withdrawal services, and does not participate as a buyer or seller in your trades.
Digital assets are highly volatile and speculative. Markets may be untested and subject to material regulatory changes. You may lose all or a substantial portion of your funds.
You are solely responsible for evaluating the truthfulness, legality, and validity of any asset or information and for all trading decisions and outcomes. Nothing on the Website constitutes investment, financial, or trading advice.
2) Eligibility & Your Responsibilities
By opening an account or using the Services, you represent and warrant that:
You are at least 18 years old (or the legal age of majority in your jurisdiction) and have full capacity to enter into this Agreement.
Your use of the Services complies with applicable laws and sanctions rules; you are not listed on FATF, OFAC SDN, UN sanctions, or similar lists.
You are the lawful owner of the digital assets you use or transfer and the withdrawal addresses you provide are under your exclusive control.
You will not engage in market manipulation or other abusive conduct (e.g., wash trading, spoofing/layering, quote stuffing, front-running).
You understand the risks of using the Services and of digital-asset markets.
YUBIT may restrict or refuse Services in certain jurisdictions (including, without limitation, where derivatives access is prohibited). If we determine that you misrepresented your location or eligibility, we may close your account and liquidate open positions in accordance with platform rules.
3) Account Registration, Security & Compliance
You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for safeguarding your credentials (passwords, 2FA, security codes) and for all activity under your account. Notify YUBIT immediately of unauthorized use.
YUBIT may conduct KYC/AML/CTF checks, request additional documents at any time, and verify identity on an ongoing basis. We may impose transaction limits or suspend features pending verification.
4) Platform Use & Acceptable Conduct
You may not use the Services in any manner that:
Damages, disables, or impairs the Website or interferes with any other party’s use;
Is illegal, fraudulent, or harmful, or promotes such activities;
Involves uploading or distributing malware, spyware, or harmful code;
Uses automated data collection (scraping, crawling, mining) without prior written consent;
Attempts to access other users’ accounts or platform areas without authorization;
Circumvents, disables, or interferes with security or integrity controls.
YUBIT may suspend, restrict, or terminate access to preserve market order, security, or compliance (including setting Reduce-Only mode, canceling or adjusting trades that deviate from an orderly market, or pausing trading during market disruptions).
5) Market Data & Availability
Market data and content are provided “as is” without warranties of timing, sequence, accuracy, or completeness. Service operation and Website availability may be intermittent; YUBIT is not liable for delays, interruptions, or connectivity issues.
6) No Advice
Communications, prices, charts, research, blogs, and other information on the Website are general market commentary and not investment advice. Trades are executed automatically per your instructions and published execution procedures. You are solely responsible for determining suitability in light of your objectives, financial situation, and risk tolerance.
7) Fees, Calculations & Adjustments
Fees (including trading, withdrawal, and other applicable fees) are disclosed on the platform and may adjust dynamically with network conditions and market factors.
All calculations performed by YUBIT’s matching/settlement engine and verified by YUBIT are final.
Where YUBIT reasonably determines that an execution price materially deviates from an orderly market (e.g., due to technical error or disruption), YUBIT may cancel or adjust the affected trade(s).
8) Indemnification
You agree to indemnify, defend, and hold harmless YUBIT, its affiliates, officers, directors, employees, agents, licensors, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your breach of this Agreement or applicable law; or (c) your violation of third-party rights.
9) Disclaimers & Limitation of Liability
Disclaimers. The Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind—express, implied, or statutory—including merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
Limitation. To the maximum extent permitted by law, YUBIT (and its suppliers/licensors) shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive damages, loss of profits, revenue, data, goodwill, or business interruption, whether based in contract, tort, strict liability, or otherwise—even if advised of the possibility. In all cases, YUBIT’s total aggregate liability shall not exceed the fees you paid to YUBIT in the six (6) months preceding the event giving rise to the claim.
YUBIT shall not be responsible for failures or delays caused by events beyond our reasonable control (including force majeure, regulatory changes, sanctions, power/network failure, severe market disruption).
10) Intellectual Property
All intellectual property in the Website and Services (designs, layouts, graphics, software, code, data compilations, and trademarks) is owned by YUBIT or its licensors and protected by law. Using the Services does not transfer any IP rights to you.
If you submit content to public areas (e.g., forums), you grant YUBIT a worldwide, royalty-free, non-exclusive, irrevocable license to use, reproduce, modify, publish, translate, create derivative works, distribute, publicly perform/display, and sublicense such content for the full term of rights.
11) Privacy
Our collection and use of personal data are described in the Privacy Policy (incorporated by reference). We collect information needed to provide and secure the Services, comply with KYC/AML/CTF obligations, prevent fraud/abuse, communicate with you, and improve performance. We implement appropriate technical and organizational security measures but cannot guarantee absolute security. You should also adopt independent safeguards.
12) Suspension, Termination & Survival
YUBIT may modify, suspend, or terminate any or all Services at any time. Upon termination, YUBIT has no obligation to retain or disclose account information or to forward messages. Sections intended to survive (including, without limitation, Indemnification, Disclaimers, Limitation of Liability, IP, Privacy, Governing Law) shall survive termination.
13) Changes to These Terms
We may change these Terms at any time. For material changes, we will provide notice through your account or on the Website. Your continued use after changes become effective constitutes acceptance.
14) Severability; No Waiver
If any provision is held invalid or unenforceable, the remaining provisions remain in full force. YUBIT’s failure to enforce any right is not a waiver of that right.
15) Governing Law & Jurisdiction
This Agreement is governed by the laws of Hong Kong. Any dispute arising out of or relating to the Services or this Agreement shall be subject to the exclusive jurisdiction of the courts of Hong Kong. The doctrine of forum non conveniens does not apply.
